“Model Hires,” “we,” “us,” or “our” refers to the platform operator.
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, you must not use the Platform.
Model Hires is a technology platform that enables users to create profiles, showcase work, and connect with other users.
We are not:
A modeling agency, talent agency, or employment business;
A broker, intermediary, or contracting party; and
A party to any agreement between users.
We do not endorse, verify, or guarantee any user, listing, communication, or transaction. All interactions occur solely between users.
You may only use the Platform if:
You are at least 16 years old (or the age of majority in your jurisdiction);
You have legal capacity to enter into binding agreements; and
You comply with all applicable laws.
We may suspend or terminate access at our sole discretion.
You agree to:
Provide accurate and complete information;
Maintain the confidentiality of your login credentials; and
Be fully responsible for all activity under your account.
We reserve the right to reclaim, suspend, or terminate accounts at any time.
You agree not to:
Use the Platform for unlawful, deceptive, or harmful purposes;
Misrepresent identity, affiliation, or qualifications;
Upload false, misleading, or infringing content;
Interfere with Platform infrastructure or security; and
Scrape, crawl, or extract data without permission.
We may investigate and take action at our sole discretion.
5.1 Ownership
You retain ownership of content you submit (“User Content”).
5.2 License to Model Hires
You grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to:
Use, host, reproduce, distribute, modify, and display User Content; and
Operate, improve, promote, and commercialize the Platform.
5.3 Platform IP
All Platform content, technology, branding, and software are owned by Model Hires or its licensors and are protected by intellectual property laws.
You may not copy, reverse engineer, or exploit any part of the Platform.
We may offer paid features, subscriptions, or transaction-based services.
You agree that:
All fees are non-refundable unless required by law;
We may change pricing at any time; and
You authorize us to charge your payment method for applicable fees.
We may use third-party payment processors and are not responsible for their services.
Model Hires is a neutral marketplace platform.
We:
Do not verify user identities unless explicitly stated;
Do not conduct background checks; and
Do not guarantee performance, safety, legality, or outcomes.
You assume all risk when interacting with other users.
We may offer optional or mandatory verification.
You acknowledge:
Verification is limited and point-in-time only;
It is not a guarantee of identity, authenticity, or conduct; and
Verification status may be revoked at any time.
We may use third-party identity providers.
We reserve absolute discretion to:
Remove or restrict content;
Suspend or terminate accounts;
Investigate violations; and
Cooperate with law enforcement.
We are not obligated to monitor content.
The Platform may integrate or link to third-party services.
We are not responsible for:
Third-party content or services;
External transactions or agreements; and
Data handling by third parties.
We may suspend or terminate your access:
At any time;
For any reason; and
Without notice or liability.
Upon termination:
Your access ceases immediately; and
We may retain or delete your data at our discretion.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DISCLAIM ALL WARRANTIES, INCLUDING:
MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
We do not guarantee uptime, security, or accuracy.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
MODEL HIRES SHALL NOT BE LIABLE FOR:
INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
LOSS OF PROFITS, DATA, BUSINESS, OR REPUTATION; AND
USER INTERACTIONS OR OFF-PLATFORM CONDUCT.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
Amount paid by you in the last 12 months; OR
USD $100.
You agree to indemnify and hold harmless Model Hires and its affiliates from any claims arising from:
Your use of the Platform;
Your content;
Your interactions with other users; and
Your violation of law or third-party rights.
We may assume exclusive defense at your expense.
15.1 Arbitration
Any dispute shall be resolved by binding arbitration.
15.2 Class Action Waiver
You agree to resolve disputes individually and waive any right to class actions.
15.3 Jurisdiction
Governing law: State of New York.
We may enforce rights in any jurisdiction globally.
We may:
Modify or discontinue any part of the Platform; and
Update these Terms at any time.
Continued use constitutes acceptance.
You may not use the Platform if:
You are under 16;
You are prohibited by law; and
Your account has been previously terminated.
You expressly acknowledge that:
The Platform facilitates interactions between independent parties;
We do not supervise, control, or guarantee user conduct; and
You assume full responsibility for all decisions and engagements.
We are not liable for failure or delay due to events beyond our control, including:
Cyberattacks
Infrastructure failures
Natural disasters
Government actions
We may assign or transfer these Terms without restriction, including in connection with:
Mergers
Acquisitions
Asset sales
You may not assign your rights without our consent.
These Terms constitute the entire agreement between you and Model Hires and supersede all prior agreements.
By using the Platform, you confirm that you have read, understood, and agree to these Terms.
